Public Spaces Protection Order (PSPO) for Parks & Open Spaces

The Anti–Social Behaviour, Crime & Policing Act 2014 commenced on 20 October 2014.  One of the powers available through this legislation is a Public Spaces Projection Order (PSPO) which is designed to stop individuals or groups committing anti-social behaviour in a public space.

 

We seek to use this legislation to help deal with several types of anti-social behaviour (detailed in the report) in parks & open spaces.

 

The legislation requires public consultation before making such an Order.

 

The statutory requirement is to consult with the chief officer of police and the local policing body for the area, whatever community representatives the local authority thinks appropriate and any owner or occupier of land within the restricted area.

 

A PSPO, once made, is valid for 3 years and, if still required, should be renewed before the expiry date.

 

The purpose of the report is to ask Cabinet to approve the 12 week statutory consultation period .
